At Ask Generator, we respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe that your copyrighted work has been infringed upon on our website, please follow the procedure outlined below to notify us.
1. DMCA Takedown Notice
If you are the copyright owner or authorized to act on behalf of the copyright owner, and you believe that your work has been copied in a way that constitutes copyright infringement on our website, please provide us with the following information to process your DMCA Takedown Notice:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notice, please provide a representative list of such works.
- Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material on the website (e.g., URL(s) of the allegedly infringing content).
- Your contact information, including your full name, mailing address, phone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Once we receive a valid DMCA Takedown Notice, we will promptly remove or disable access to the infringing material.
2. Counter-Notice
If you believe that your content was removed in error or that you have the right to use the material in question, you may submit a Counter-Notice to us. A valid Counter-Notice must include the following information:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location where the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
- Your contact information, including your full name, mailing address, phone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or if your address is outside the United States, for any judicial district in which Ask Generator may be found, and that you will accept service of process from the person who provided the DMCA Takedown Notice.
We will review the Counter-Notice and, if appropriate, restore the material to our website within 10-14 business days unless we receive notice from the original claimant that they have filed a lawsuit seeking to prevent the restoration of the material.
3. Repeat Infringers
In accordance with the DMCA, we maintain a policy of terminating the accounts of users who are found to be repeat infringers. If we receive multiple valid DMCA Takedown Notices regarding the same user or content, we will take appropriate action to remove or disable access to that content and may terminate the user’s account if warranted.
